THE STATE OF OUR AFFAIRS
GENERAL INFORMATION: FACTS MGBIDI PEOPLE ARE ENTITLED TO KNOW
 
Dear fellow brothers and sisters:
BACKGROUND: As “Nwa Akpuru Mgbidi” it is imperative to once again inform our people and those who have been in the dark of pertinent facts and the status of the effort in a country of laws to play by the rules.


As most of you will remember, every effort was made and continued to be made by some of our right meaning folks to resolve the issues surrounding the Mgbidi Community USA, Inc (hereinafter “Mgbidi Community USA”) affairs which deteriorated as a result of the failure and vacuum of leadership, the ineptitude, and misappropriation of the funds raised in Boston in 2004 convention and other serious matters. In addition, the Houston branch/chapter leadership failed to host the 2006 convention which was cancelled by Mr. Alex Anyikam (after Mr. Anyikam initiated to secretly utilize (without the peoples authorization) the funds raised in Boston and earmarked for scholarship for Houston use for staging convention and was notified by Boston that he cannot do so).


As the initiators of the issues facing us, Mr. Anyikam and his group (or those he is leading to no where) erroneously and falsely informed the people that the Mgbidi Community USA, Inc resolution to start financing conventions was NOT stipulated to start in Boston in 2004 (while ignoring the documents and evidences that he himself signed with others prior to Boston convention as agreed that 2004 convention will be financed Nationally and by payment of dues - see attached). It seems that some of our folks engage in village way of life when it suits them by having momentary amnesia that they and their chapters/members failed to pay one single penny to finance the National convention held in Boston in 2004 as mandated in our constitution. These documents which include the Alabama Accord of 2003, the Washington DC 2003 Communiqué and the Amended Constitution was forwarded (after they contacted us in Boston) to his supporters who were in the dark and were been misled (Mrs. Julie Onwugbufor, Mr. Malachy Nzekwe and Mr. Walter Ihebilike). Despite the clear and convincing evidence, their own admissions and the information provided and pleas to sit down and resolve the problem created by the same detractors peacefully. It did not happen because people were more concerned of their loyalties.


For many days, weeks and months, we endeavored through all channels to have a meeting to peacefully resolve our issues. For many months we made every effort to reach many in order to find lasting solutions that have since eluded us. Finally, after a telephone conference that was initiated and scheduled by Mr. Ezenyi, the three branches/chapters and some of our people engaged in a teleconference and agreed to meet in a summit to resolve the aforementioned issues with each of the three chapters nominating representatives in addition to the officials. Once again, Mr. Anyikam refused to abide by the agreement and instead chose to form his own group. Notwithstanding, the meeting was finally scheduled and every one notified, Mr. Ezenyi and his co-horts agreed to appear but did not attend because of the shame their conduct brought to the Mgbidi Community or for fear their scheme would be discovered. Meanwhile, the executives and members of the Mgbidi Community USA, Inc from Boston and Washington DC complied and fully deliberated on September 2, 2007 in New Jersey.


Following resolutions that were later adopted, all efforts were made following the summit to move Mgbidi Community USA Inc forward and recover its property through dialogue. However, Mr. Ezenyi and his co-horts (whose terms of office expired in 2006) refused to meet, refused to release Mgbidi Community USA, Inc property to the appointed Caretaker Committee. Left with no option, the legal action was instituted to recover all Mgbidi Community USA property and the funds raised in Boston which we learned through a “falling out” among the Defendants that the Defendant, Mr. Ezenyi had withdrawn without authorization, and had previously deposited our funds in his own co-partnership account without authorization.


LEGAL ACTION IN BOSTON: Prior to the legal action against Mr. Ozoillo, Mr. Ezenyi, Mr. Onye and Mrs. Omerenna was instituted in Boston by and on behalf of the Mgbidi Community USA and all our people who believe in justice for all, we have endeavored to ONLY report on the facts and issues surrounding our folks. To that effect we once again bring the following facts as they have been exposed as follows:
1. That the Legal action filed to retrieve the Mgbidi Community USA property and the funds raised in Boston in 2004 against the aforementioned Defendants is still ongoing and that the Court has denied the Motion to Dismiss filed by Mr. Ezenyi and his co-horts (the Court also dismissed one of the four counts stated in the Complaint which we expect to amend and re-file to the extent allowed by law). Simply put, upon the denial of their Motion to Dismiss, the case against the Defendants has been ALLOWED TO PROCEED. We attach and incorporate the decision rendered by Judge Saranson for all to read as Document 1.


2. As one of the most important revelation learned while seeking justice, the people of Mgbidi as a result of the within law suit, learned for the first time the extent of the scheme perpetrated by Mr. Ezenyi which included, his forming in 2002 a different organization which he termed “A Virginia co-partnership” known as “MCU-MGBIDI Community USA” for himself and Mr. Ike Umunnah. The document he presented in Court is attached as Document 2. Please be advised that those who claim to be members of a “Virginia co-partnership” known as “MCU-MGBIDI Community USA”, you are members of the co-partnership owned and only operated by Mr. Ezenyi and Mr. Umunnah.


3. For all of our folks who have been to our conventions we are a distinct and different organization which officially adopted its Logo, constitution in Boston in 1999 and known as “MGBIDI COMMUNITY USA, INC.” A look at the records and our conventions, communiqués, resolutions, meetings and the documents signed by our people evidences the truth which no matter how you try to confuse, mislead, misrepresent and fool yourself as the defendants do, you can not cover the truth. Refer to all records and documents signed by the Mgbidi people from 1999 until this fraud was uncovered.


4. Furthermore, there were numerous revelations in Court, including Mr. Ezenyi and his co-horts stipulations, admissions and statements in their motions that “the four Defendants are the duly elected officers of MCU-Mgbidi Community USA, a Virginia co-partnership of Ike I. Umunnah and E. Anthony Ezenyi”.


5. Yes indeed, the Defendants have in a space of this legal action changed their stripes like chameleons and answered more than three names: “MUSA, “MGBIDI USA” and “Virginia co-partnership” owned by only Mr. Ezenyi and Mr. Umunnah termed “MCU-MGBIDI Community USA”.


6. Notwithstanding, Mr. Ezenyi and his co-horts falsely and erroneously argued that “in 1999, the defendant Ezenyi was instrumental in drafting of a constitution for MCU – Mgbidi Community USA”. However, it is perplexing and laughable for such a statement in light of all reason and the mere fact that when the constitution of Mgbidi Community USA, Inc. was written in Boston (by people other than Mr. Ezenyi), his front organization, “the Virginia co-partnership of E Anthony Ezenyi and Ike Umunnah” was not in existence, was never heard of, was never a part of our people’s organization and had never been connected with any of our people’s conventions or meetings until it was exposed as a result of the within law suit. Furthermore, it is not only public record but well known by all (together with admissions by Mr. Ezenyi and his co-horts that Mr. Ezenyi and the Washington Branch were on suspension and not part of our organization from 2001 till after the Alabama summit and accord. We refer to the attached Document 3.

CONCLUSION:
We hope that we have endeavored to inform our people on the status of the above matter. In addition, we will continue to notify our people truthfully of the developments of the within matter. As we all are planning to meet in Washington DC for our convention on July 24-25, 2009, we hope that our people reflect on these matters and understand once again that every effort was made to resolve these matters through dialogue. However, when you do not believe in facing the truth and reality, you tend to use diversionary and fraudulent ways that at the end catches up with one who engages in such conduct.

Finally, we as the members of Mgbidi Community USA, Inc. (the organization belonging to the people of Mgbidi which adopted its name and constitution in Boston in 1999 and which has officially incorporated) are in NO way affiliated with Mr. Alex Okorie Anyikam’s “MUSA”, “MGBIDI USA” and sure has NO affiliation with the one personally owned by Mr. Ezenyi and his partner called a “Virginia co-partnership” or “MCU-MGBIDI Community USA” formed in 2002. Furthermore we live in a free society where every one is entitled to join any group or co-partnership that they want. However, you cannot misrepresent, mislead, defraud and engage in “419” in the Commonwealth of Massachusetts or in the United States and take the people’s funds and say “catch me if you can”. We live in a country of laws where local way of doing things and defrauding the people is unacceptable and totally disallowed by the law. For that, we will continue to seek the truth and justice for all.
